AFEW GAMBLE WEEK Terms and Conditions

1. Organizer

The organizer of the AFEW GAMBLE WEEK is AFEW GmbH, represented by Managing Directors Marco Biergen and Andreas Biergen, Oststraße 36, 40211 Düsseldorf, Germany (hereinafter referred to as "AFEW STORE" and/or "Organizer" and/or "we").

2. Participation

Eligible participants are natural persons over the age of 18. Participation in the raffle requires a valid order at AFEW STORE during the promotion period and applies only to orders placed via our online shop.

3. How to Participate

To enter:

   Place an order using the code GAMBLE22 between 04.11.2024 00:00 CET and 10.11.2024 23:59 CET. Each order automatically enters you into the AFEW GAMBLE WEEK raffle for a chance to receive a refund¹ equivalent to your purchase amount as an AFEW shopping voucher.
    
2. 30 Days to Reward 📅
   
   Each order placed with the code during the promotion period enters the AFEW GAMBLE WEEK raffle. Orders that are fully or partially returned or canceled are excluded.
    
3. GAMBLE WIN 🏆
   
   After the return period, we will contact winners via email.
    

Every order placed during the promotion period (04.11.2024 to 10.11.2024) through our web shop automatically enters you into the raffle. Only the value of items fully retained by the customer will be refunded.

4. Deadline, Number of Possible Entries

The raffle runs from 04.11.2024 00:00 to 10.11.2024 23:59 CET. Late entries, regardless of the reason, will not be considered. Every order placed during the promotion period counts as a raffle entry.

5. Prizes, Raffle Draw (Lottery), and Notification

Among all eligible orders, we raffle off the following prize: a voucher for AFEW STORE equal to your retained, non-returned order value. Orders that are partially or fully returned or canceled do not qualify for entry.

Winners will be notified via email on 16.12.2024 through the email address used when ordering. By entering the raffle, you agree to be contacted solely for the purpose of notifying you of a win.

6. Prize Redemption (Prize Distribution)

Prizes will be awarded via email to the address used for the order. Data provided will only be used for prize distribution and not for future raffles. This does not affect any retention obligations under applicable commercial and/or tax law. Any costs arising from prize redemption/use are not covered. The winner is solely responsible for any tax matters.

7. Cash Payment/Exchange/Assignment

The prize cannot be exchanged, assigned, or paid out in cash.

8. Raffle Termination

The Organizer reserves the right to change the raffle period or terminate the raffle at any time and without notice, e.g., in the event of technical issues or if there is a suspicion of an attempt to manipulate the raffle.

9. Disqualification from Participation

Participation through automated procedures or other manipulation attempts (including by third parties) is prohibited, as are violations of or attempts to circumvent these terms. The Organizer reserves the right to exclude participants from the raffle or retract prizes in cases of suspected fraud or violation of the terms.

10. Liability

The Organizer is not liable for direct, indirect, or special losses and/or damages arising from participation, including those caused by communication disruptions, power outages, mobile carrier failures, malicious software, unauthorized third-party actions, or force majeure. In such cases, the Organizer is not obligated to compensate participants for losses. The Organizer is liable for damages caused by gross negligence, intent, or breaches of life, body, or health under statutory provisions. Liability is limited to foreseeable, typical damages for slightly negligent breaches of essential duties (cardinal obligations). This liability limitation also applies to representatives and agents of the Organizer.

11. Data Protection

The Organizer uses participants' data in compliance with German and European data protection law.

Your Rights
In addition to the right to withdraw any consent provided, you also have the following rights if statutory requirements are met:

• Right to access your personal data stored with us (Art. 15 GDPR);
• Right to correct incorrect or complete accurate data (Art. 16 GDPR);
• Right to delete your data stored with us (Art. 17 GDPR), unless statutory or contractual retention periods or other statutory rights or obligations require further storage;
• Right to restrict the processing of your data (Art. 18 GDPR) if the accuracy of your data is disputed, the processing is unlawful, but you oppose deletion; or we no longer need the data, but you need them to assert, exercise, or defend legal claims, or you have objected to processing under Art. 21 GDPR;
• Right to data portability (Art. 20 GDPR), i.e., the right to have your data in a common, machine-readable format transmitted to another controller at your request;
• Right to lodge a complaint with a supervisory authority, typically in the place of your habitual residence, workplace, or our corporate headquarters.

12. Final Provisions

German law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory provisions of the participant’s residence state remain unaffected. Should any provision of these terms be invalid or contrary to legal provisions, the remaining conditions shall remain unaffected and valid under statutory provisions. The same applies to filling contractual gaps. Legal recourse is excluded.

As of November 2024
